Steve Adamsky and Elana Goodman Obtain Defense Verdict for Daycare Center; Verdict Upheld on Appeal

The Defendant day care center was sued after a 4 year old girl  injured herself while running in the playground at the day care center.  Although the child sustained a fairly minor laceration on her foot, she was left with a permanent scar.  The Plaintiff demanded $1 million.  Steve and Elana tried the case and obtained a defense verdict.  Plaintiff’s counsel appealed and pursued a new trial.  The Defendant in turn appealed the trial court’s denial of  its claim for attorney’s fees and costs pursuant to the proposal for settlement statute, based upon an alleged ambiguity in the proposal.  The Defendant prevailed on both appeals.  The appellate court affirmed the jury verdict of no liability and found that the trial court erred in denying the claim for attorney’s fees and costs pursuant to the proposal for settlement statute.
